The Attorney General is to seek an increase in the four-and-a-half-year jail term handed to a terrorist.
Baroness Scotland QC will refer the case of Sohail Qureshi to the Court of Appeal on the grounds that his punishment was unduly lenient.
Qureshi, a 30-year-old dentist, was detained as he boarded a plane to Pakistan in October 2006.
He was carrying night sights and computer discs full of military information, and Scotland Yard's anti-terror chief suggested Qureshi might have been planning to target British soldiers in Afghanistan.
The Old Bailey heard Qureshi admitted he was on his way to carry out a terrorist mission and told fellow extremists he planned to "kill many".
