Leave custody decision to UK - call

12 April 2012

A Scottish councillor has called for a Pakistani court involved in the custody battle of a 12-year-old girl to leave decisions to officials in the UK.

Glasgow Labour councillor Hanzala Malik said overseas courts taking up cases that had already had a ruling in the UK made the British courts system look "like a laughing stock".

The comments came as news emerged that Lahore Civil Court has awarded the father of Molly Campbell a temporary custody extension up to October 21.

Mr Malik said he had received news of the court decision on Saturday morning.

Molly, also known as Misbah Rana, left her mother in Stornoway, Lewis, in August to be with her father and older sister in Pakistan.

Louise Campbell, Molly's legal guardian, was awarded custody last year and is calling for the Pakistani courts to reverse the decision to grant temporary custody to her ex-husband, Sajad Ahmed Rana.

It is understood Mr Rana was granted an extension in order to give time for his lawyer to reply to Mrs Campbell's objections.

Mrs Campbell has also filed a case at Lahore High Court that her daughter was illegally taken. The next hearing of that case is expected to be on October 9.

On Tuesday, the same court ordered that Molly's father surrender her passport. Molly herself says she travelled to Pakistan of her own free will and wishes to remain there.

Mr Malik, himself a Pakistani, said he did not not specifically want to speak about Molly's case, but said he was concerned that decisions made regarding vulnerable people by UK courts were not being honoured.
