Man escapes jail for filming sex with wife

A man who set up a video camera in his bathroom so he could secretly film sex sessions with his wife without her knowledge escaped a prison sentence today.

The 55-year-old man, who cannot be named for legal reasons, was sentenced to a nine-month community rehabilitation order for the offences committed last October.

Yate Magistrates' Court in Bristol heard that the man had linked the bathroom camera to a television in his bedroom for "sexual gratification".

Jan Fish, prosecuting, said the man's wife unwittingly discovered the camera on October 22 when she turned on the bedroom TV to be confronted with a live image of her husband naked in the bath.

After confronting her husband about the camera, she left the house.

On her return she discovered a recorded confession in which her husband admitted setting up the camera so he could watch her in the bath.

She called the police and her husband was arrested.

He told officers that he had purchased and installed a closed circuit television camera in the bathroom.

Mrs Fish said: "He stated the reason for doing this was for watching his wife in the bath and he had planned to watch them together in the bath for their sexual gratification."

The man pleaded guilty to three counts of voyeurism at an earlier hearing.
Debbie Bakehouse, defending, said the wife had thrown her husband out of the home they shared in a South Gloucestershire village and she was now filing for divorce.

She said: "He tells me that his intentions were to view the footage with his wife.

"He now understands that he should have got his wife's consent before any of this took place."

The man was ordered to pay £130 costs and an order was made to destroy the surveillance and recording equipment.

The offence of voyeurism entered English law in the 2003 Sexual Offences Act.
