Dwarf wins victimisation case

A 4ft 4in dwarf who said he was verbally abused and humiliated by bosses at a supermarket has won a discrimination claim.

Scott English, 19, said he was was forced to stand on freezer units to put goods on display at the Kwik Save store in Whittlesey, Cambs, after his requests for a ladder were denied.

A panel which heard the claim at an employment tribunal in Bury St Edmunds, Suffolk, in December, has ruled that Mr English was discriminated against and victimised under the Disability Discrimination Act.

But members decided that he was not constructively dismissed nor victimised after he complained. A decision on damages has yet to made.

At the hearing, supermarket manager Simon Mutton denied the allegations and said he "hadn't got a clue" why Mr English, who resigned from his job, had launched the claim.

Mr Mutton said all members of staff sometimes had to climb on to freezers to reach shelves.
