A bid to deport a failed asylum seeker who killed a 12-year-old girl in a hit-and-run reaches the Court of Appeal today.

Aso Mohammed Ibrahim, an Iraqi Kurd who was already banned from driving, left Amy Houston dying under the wheels of his car in Blackburn, Lancashire, in 2003.

He was jailed for four months over her death, but allowed to remain in the UK on his release.

The UK Border Agency (UKBA) appealed against the decision, backed by Amy's father Paul, but that was rejected by two immigration judges last year.

Now, two judges in the Court of Appeal in London will hear the agency's case.

Ibrahim's lawyers have argued that human rights laws permit him to stay in the UK, where he now has a family.

Amy's father, a 41-year-old engineer from Darwen, Lancashire, had to make the decision to turn off Amy's life support machine hours after the crash and has been campaigning for years to get Ibrahim deported.

Mr Houston is expected to attend today's hearing before Lord Justice Sullivan and Lord Justice Gross.
